〔ショップ説明〕
「VirtualAsset（バーチャルアセット）」は主にバーチャル上で活動している人々を対象に背景素材などの販売や背景イラストの受注を承っているサイトです。

このサイトは今後益々発展していくバーチャルコンテンツに少しでも貢献していきたい思いで作りました。配信画面の質やバーチャル生活の質を向上できたり、インターネットの海からバーチャルコンテンツに適した素材を探す手間を減らせたりできたら幸いです。

■素材の利用規約■

1.適用
・本規約はVirtualAsset販売のデジタルデータを使用されるお客様に適用されます。

2.定義
・VTuber:本規約でのVTuberはYouTubeだけに限らずあらゆる動画、生放送配信プラットフォームにてアバターを用いて活動されている活動者のことを指します。
・2D:本規約での2Dは背景イラストや配信オーバーレイなどのデジタルデータのことを指します。形式はPNGやJPEGなど。
・3D:本規約での3DはFBXやOBJ形式等の3Dモデルデータのことを指します。

3.使用上可能なこと
○2Dの場合
・自由なデータの改変。
・禁止行為を含まない範囲での商用利用（クレジット表記不要）。
・YouTubeやTwitch、bilibili、ツイキャス等の配信プラットフォームにて生配信や動画投稿される際の素材としてのご利用。

○3Dの場合
・自由なデータの改変。
・禁止行為を含まない範囲での商用利用。
・漫画やイラスト等の素材としてのご利用（クレジット表記不要）。
・ゲーム素材としてのご利用（クレジット表記必要）。
・VRchatやCluster等のVRプラットフォームでのご利用（クレジット表記不要）。

4.禁止事項
○2Dの場合
・AI学習
・配布、販売。
・犯罪行為に関連するご利用。
・ゲーム背景としてのご利用。
・グッズ等の販売物でのご利用 。
・VTuberに関係のないことでのご利用。
・特定の宗教思想や政治目的のためのご利用。
・性的及び著しい暴力的コンテンツでの利用。
・法令または公序良俗に違反する行為でのご利用。
・第三者の知的財産権を侵害する行為でのご利用。
・第三者の名誉・信用を毀損または不当に差別もしくは誹謗中傷する行為でのご利用。

○3Dの場合
・配布、販売。
・犯罪行為に関連するご利用。
・グッズ等の販売物でのご利用 。
・特定の宗教思想や政治目的のためのご利用。
・性的及び著しい暴力的コンテンツでの利用。
・法令または公序良俗に違反する行為でのご利用。
・第三者の知的財産権を侵害する行為でのご利用。
・第三者の名誉・信用を毀損または不当に差別もしくは誹謗中傷する行為でのご利用。

5.規約変更
・本利用規約は予告なく変更される場合があります。

6.免責事項
・販売データは改変の有無にかかわらず、著作権はVirtualAssetに帰属します。
・販売データは予告なくアップデート、販売の停止が行われる場合があります。
・素材をご利用されることによって発生したトラブルにつきましては販売元は一切の責任を負いかねます。

“VirtualAsset” is a website offering background assets and taking requests on background illustrations for those who take part in activities virtually.

This website was created with my desire to contribute to the virtual contents bound to continue evolving. ■Terms and Conditions for Assets■

1. Application
• These Terms apply to customers who use the Digital Data that VirtualAsset offers.

2. Definitions
・VTuber: “VTuber” in these Terms refers to anyone using an avatar to take part in any video or live streaming platforms, not limited to YouTube.
・2D: “2D” in these Terms refers to digital data such as background illustrations and streaming overlays. Formats include PNG and JPEG, etc.
・3D: “3D” in these Terms refers to 3D model data such as in FBX and OBJ format, etc.

3. What is allowed
○ For 2D
・Free to modify purchased data.
・Commercial use, excluding prohibited acts (credit notation not required).
・Use as asset for live streaming and video-posting on streaming platforms such as YouTube, Twitch, bilibili and Twitcasting.

○ For 3D
・Free to modify purchased data.
・Commercial use, excluding prohibited acts.
・Use as asset in manga, illustrations, etc. (credit notation not required).
・Use as asset in console/mobile games/apps (credit notation required).
・Use on VR platforms such as VRchat, Cluster, etc. (credit notation not required).

4. Prohibited matters
○In the case of 2D
・Distribution and sale.
・Use in connection with criminal activities.
・Use as background on console/mobile games/apps.
・Use in merchandise or goods, etc.
・Use for non-VTuber-related activities.
・Use for specific religious or political purposes.
・Use in sexual and significantly violent contents.
・Use in acts that violate laws and regulations or public order and morals.
・Use in acts that infringe intellectual property rights of a third party.
・Use in acts that damage honor or credibility of a third party, or unfairly discriminate or defame a third party.

○ In the case of 3D
・Distribution and sale.
・Use in connection with criminal activities.
・Use in merchandise or goods, etc.
・Use for specific religious or political purposes.
